The Notice was deemed <br />inappropriate for purposes of filing for the following reason: <br />Sincerely, <br />• Expressed intent to occasionally remove stockpiled aggregates. <br />Pursuant to Rule 1.13.2(5) of the Mineral Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for the Extraction of Construction Materials, the sale or processing of <br />material or movement of stockpiled material contraindicates temporary cessation. <br />The Division recommends the Operator withdraw the TC and apply for a Technical Revision <br />(TR) to the permit in order to change the mine plan to an intermittent operation pursuant to Rules <br />6.3.3(a) and 6.4.4(e). The fee for a 112c TR is $216. The Division can apply the $144 fee <br />received for the TC towards the TR fee, but will require the additional $72 to process the TR.
