Rule 2.03.10 requires the identification of other licenses <br />and permits. Please address this rule. <br />4. The proposed methane utilization facility pad site is situated within 100 feet of the Elk Creek <br />stream buffer zone. Please address Rule 2.05.3(3)(a) for the facility and Rule 4.05.18 <br />regarding the pad site in the revision application <br />5. The revision text states that "there is a preference that the facility remains in place after the Elk <br />Creek mine is sealed and reclaimed." Since the facility is not written into the permit as <br />permanent, the Division considers the facility temporary and will be removed with the <br />reclamation of the mine. The cover letter stated that alluvial monitoring well EC -14 will be moved updip to <br />accommodate the methane utilization facility. No information was included in the application <br />describing the relocation of well EC -14. Please provide information regarding the relocation of <br />the well including maps and text and address the requirements of Rule 4.05.13(1)(e) for the <br />new well and Rule 4.05.13(1)(e)(ii) and Rule 4.07 for EC -14. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review or otherwise make your <br />application complete based on the items listed above.
