Box 721 <br />Lamar, Colorado 81052 <br />RE: White Sand and Gravel Pit; DRMS File No. M- 2010 -062; Submittal of Financial Warranty <br />Dear Mr. Peterson, <br />The Division of Reclamation Mining and Safety (Division) received your request for an extension to <br />submit the required Performance and Financial Warranties for the approved White Sand and Gravel Pit <br />application. However, the Division cannot approve this request at the staff level. In accordance with <br />Rule 4.1 (2) of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials, if the Performance and Financial Warranties are not received <br />within one calendar year of approval of an application for a permit, the Board shall hold a hearing in <br />accordance with the public notification and comment provision of Rule 1.6. At the hearing, the Board <br />shall reconsider the previous approval of the application.
