Mines is now $3,590,971.00). The Division will propose a decision for Surety Increase 1
(SI -01, to be sent under separate cover). SI -01 will provide a permitting action for MCM
to submit the required bond rider.
In summary, the Division issued written findings on 28 June 2011 as part of the Midterm
Review required by Rule 2.08.3. The Division found the Williams Fork Mines permit is
out of date in a number of areas. Pursuant to Rule 2.08.3(3), the Division required MCM
to submit a revision to either reclaim the site or submit a revised mine plan with the intent
of resuming mining operations. To date, MCM has not submitted the required revision.
If MCM disagrees with the Division's midterm findings, Rule 2.08.3(5) allows MCM to
request administrative review. Alternatively, enforcement action may be necessary if
MCM continues to delay the required revision submittal.
Please contact me at (303) 866-3567 X8145 if you have any questions or comments.
Sincerely,
James R.
