Everist, Inc., I will respond - to <br />your October 4, 2011 adequacy review letter in order and <br />number format presented in that document. <br />Exhibit B - Index Map (Rule 6.4.2) <br />This comment touches on several exhibits, but it appears here first... <br />The provided maps show a segment of the access road from WCR 120 in the SE corner of the permit <br />exiting and then re- entering the permit boundary. It appears that the road crosses property owned by GMS <br />Land & Cattle Co LLC. Unless this segment is a pre- existing roadway that will not be modified or <br />improved, it should be included in the permit area. This road segment could also raise legal access, and <br />damage waiver issues as well (Exhibits A, N, 0 and perhaps S). Please address as appropriate. <br />The land in question is part of a larger parcel owned by L.G. <br />Everist, Inc. It lays within the Lehr Pit (M- 1983 -213) oper- <br />ated by Weld County under a lease with L.G.. Everist, Inc.. <br />The road from the Southeast corner of the permit area to the <br />north line of the County Permit area, the section you refer to <br />was an improved road,. existed prior to L.G. Everist, Inc. <br />permitting the Carr Gravel Resource in 1988. I have clarified <br />the Ownership Maps to show the area north of WCR 120 and in <br />the Lehr Pit is part of the property owned by L.G. Everist, <br />Inc. There is no need to improve or modify the road only do <br />regular routine maintenance on it. <br />L.G. Everist, Inc.,, sent me a couple of.documents addressing <br />the road that crosses the Lehr Pit (M -1983 -213) operated by <br />Weld County. The first document was the ASSIGNMENT AND ASSUMPTION <br />OF LEASES for the property they purchased from Lehr, and the <br />second was a copy of the AGREEMENT FOR USE OF SOIL AND /OR GRAVEL FOR <br />ROAD PURPOSES (lease) between Lehr and Weld County. Both are <br />attached for your review. <br />
