Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />Division of Reclamation, <br />This letter is in response to your application of May 9, 2011 requestie water <br />supply plan ( "SWSP ") for a sand and gravel pit, known as the Eagle Pit (also referred to as the <br />Chambers Pit), to be operated by Lafarge West, Inc. ( "Lafarge" or "Applicant ") in accordance with § <br />37 -90- 137(11), C.R.S. The Applicant shall be responsible for compliance with this SWSP, but the <br />State Engineer's Office may also pursue the landowner, for eventual compliance. The mine is <br />permitted with the Division of Reclamation, Mining, and Safety under File No. M -80 -136. The $257 <br />fee has been accepted with receipt no. 3650239. <br />The Eagle Pit is located in the NE 1/4 of Section 6, Township 5 South, Range 84 West of the <br />6 P.M. and it currently operates pursuant to a change of water right and underground water right <br />that were decreed on June 12, 1990 in consolidated Case Nos. 81CW94 and 81CW291. Lafarge <br />proposes to expand mining and water uses beyond the decreed amounts outlined in consolidated <br />Case Nos. 81 CW94 and 81 CW291 and will also expose groundwater as a result of the mining <br />operation. This SWSP will replace depletions incurred by the expansion only. This SWSP will <br />work in conjunction with the above referenced change of water right and underground water right <br />to replace depletions from exposed groundwater, dewatering, and operational uses. Groundwater <br />was not previously exposed at this site. Lafarge anticipates exposing groundwater in the form of a <br />dewatering trench.
