• • Stormwater Runoff Controls: <br />As necessary, BMP storm water controls will be implemented during construction. Appropriate <br />BMP's, where needed, will prevent erosion and sedimentation into Coon Track Creek. BMP <br />controls may include sediment traps, straw bales, filter fabric, etc. As stated above, similar BMP <br />controls will be implemented, as needed, for waste rock piles. <br />• Points of Compliance: <br />No points of compliance are proposed at this time but will be addressed in a subsequent permit <br />revision. <br />(j) Specify how the operation will comply with applicable Colorado water <br />laws and regulations governing injury to existing water rights: <br />Calais is currently in compliance with existing Colorado water laws and regulations governing <br />injury to existing water rights, under its approved mining and reclamation permit. <br />(k) Regardless of DMO status, if refuse and acid or toxic producing <br />materials are exposed during mining, describe how they shall be <br />handled and disposed of in a manner that will control unsightliness <br />and protect the drainage system from pollution: <br />Given the waste rock analyses completed to date, no acid producing material is anticipated. <br />(1) Describe what measures will be taken to minimize disturbance to the <br />hydrologic balance, prevent off -site damage, and provide for a stable <br />configuration of the reclaimed area consistent with the proposed future use: <br />Calais currently manages one permitted mine water discharge point, which discharges directly <br />into Coon Track Creek under Colorado Department of Public Health and Environment (CDPHE) <br />Water Quality Control Division (WQCD) National Pollutant Discharge Elimination System <br />(NPDES) Permit CO- 0032751. <br />The permit boundary will be clearly marked to ensure all disturbances are within the approved <br />permit area. No additional areas of disturbance, other than what are proposed as part of this <br />Amendment shall occur. In addition, necessary BMP storm water control measures will be <br />implemented during construction activities, on -going mining and final site reclamation <br />operations. This is an underground mining operation, and all mine waters will be treated to meet <br />applicable water quality standards. These measures will protect against offsite damages. <br />During site reclamation, described below, the reclaimed areas will be graded so as to blend in <br />with the surrounding topography (Approximate Original Contour (AOC)), topsoiled, revegetated <br />Page 28 <br />
