6. Approval of CNO1 will resolve violations numbers MV- 2009 -007, MV- <br />2009 -033, MV- 2009 -035 and MV- 2010 -001. <br />7. The Division received objections to CN01. On March 14, 2011, the <br />Division deemed CNO1 "complex" and set a May 2, 2011 decision recommendation <br />date with a formal public hearing scheduled for June 8 -9, 2011. <br />8. On April 18, 2011 the Operator filed a response to the Division's CNO1 <br />adequacy review. The Division found that the Operator's adequacy response <br />constituted an amendment to CNO1 and notified the Operator on April 27, 2011 <br />( "April 2011 Amendment "). <br />9. On April 27, 2011, the Operator submitted a letter, to the Division <br />requesting to proceed with the April 2011 Amendment, acknowledging extension of <br />the decision deadline to June 21, 2011 and a scheduled formal public hearing for the <br />July 13 -14, 2011 Board meeting. <br />10. The original 180 -day Board - ordered deadline was set for July 9, 2011. <br />At its May 2011 meeting, the Board approved a request to extend the deadline to <br />July 14, 2011. <br />11. By letter dated June 16, 2011, the Operator, through its legal counsel, <br />requested "an extension through and including August 11, 2011 of the deadline for <br />the Division to recommend approval, approval with conditions, or denial of Wildcat <br />Mining's Section 112d -1 Application, CN -01, Wildcat Mining Corporation, May Day <br />Mine Complex, File No. M- 1981 - 185." <br />12. By letter dated July 7, 2011, the Operator, through its legal counsel, <br />requested "an extension through and including September 15, 2011 of the deadline <br />for the Division to recommend approval, approval with conditions, or denial of <br />Wildcat Mining's Section 112d -1 Application, CN -01, Wildcat Mining Corporation, <br />May Day Mine Complex, File No. M- 1981 - 185." The Board granted the Operator's <br />request. <br />13. By letter dated August 24, 2011, the Operator, through its legal <br />counsel, requested "an extension of the deadline date for the Board to recommend <br />approval, approval with conditions, or denial of Wildcat Mining's Section 112d -1 <br />Application" to allow the Board to consider the Application at its October 12 -13, <br />2011 meeting. The Staff Summary Form for Consent Agenda Items states that <br />"Wildcat and the Division are requesting an additional thirty days on this matter." <br />14.
