Pineda <br />Director <br />The following adequacy comments are provided in response to the Applicant's 110(d) Permit <br />Applicant and Environmental Protection Plan that was filed with the Division on 22 July 2011. <br />1) Rule 6.3.3 Exhibit C — Mining Plan: Exhibit C does not provide the information required <br />under Rule 6.3.3(1)(i) pertaining to ground water, nor does it state where the information might <br />be found in Exhibit U. The Applicant must describe how mining will affect the quantity and <br />quality of groundwater and the methods to be used to minimize disturbance to the groundwater <br />systems. <br />2) Rule 6.3.3 Exhibit C — Mining Plan: Exhibit C does not provide the information required <br />under Rule 6.3.3(1)(j) pertaining to water laws and regulations governing injury to existing water <br />rights, nor does it state where the information might be found in Exhibit U. <br />3) Rule 6.3.3 Exhibit C — Mining Plan: Exhibit C does not provide the information required <br />under Rule 6.3.3(1)(1) pertaining to minimizing disturbance to the hydrologic balance, off -site <br />damage, and stable configuration of the reclaimed area, nor does it state where the information <br />might be found in Exhibit U. <br />4) Rule 6.3.4 Exhibit D — Reclamation Plan: Exhibit D does not adequately address Rule <br />6.3.4(1)(d), which requires the Applicant to specify the reclamation treatment of waste rock <br />dumps and describe the measures taken to minimize disturbance to the hydrologic balance, <br />prevent off site damage, and provide for a stable configuration consistent with the proposed <br />future land use. <br />John W.
