Dudash, Joe
From: Jim Kiger [Jim.Kiger @OXBOW.COM]
Sent: Wednesday, November 17, 2010 1:59 PM
To: Kent Davenport; Bowie Resources /Bill Bear email; 'kwelt@archcoal.com'; Dudash, Joe
Cc: Steve Metheny; Doug Cox; Cody Carver; Bill Hughes; D.B. Watkins
Subject: RE: Bear No. 3 SL -4 Remaining Issues
Oxbow Mining, LLC is supportive of leaving the DMEA pole located on our property (per the 10/18/2010 map) in place
on an interim basis. The final disposition of the pole may change relative to the final future reclamation activities of the
Elk Creek Mine, but this issue is not related to reclamation of the Bear No. 3 mine.
James A. Watkins
Subject: RE: Bear No. 3 SL -4 Remaining Issues
To Whom it May Concern:
Delta- Montrose Electric Association (DMEA) owns two poles and the wire (3 phase wires and a neutral wire) connecting
the poles in the Somerset area related to this issue. A pdf map is attached to this email to clarify the location of these
facilities —see the yellow hi- lighted area for referenced facilities. The pole numbers are 50- HSB98L1 and 50- HSB98L2.
DMEA would prefer to leave these two poles and the connecting wires —as is— indefinitely. These facilities are helpful to
DMEA as a backup connection to the area electrical distribution system in the event DMEA's Somerset Substation is
unavailable. DMEA used these facilities in 2008 to serve electric Toads in the Somerset /North Fork areas while DMEA's
Somerset Substation was out of service for an upgrade. If these facilities were removed, it would be difficult to rebuild
back to this location at a future date in a timely basis, especially with the need for a railroad crossing permit. DMEA is
also willing to commit to removing these facilities at DMEA's cost whenever they are deemed no longer useful to DMEA.
Kent Davenport
DMEA
Kent E.
