Erickson <br />Response to Sixth Adequacy <br />October 11, 2011 <br />Page 22 <br />Please submit fully executed compensation agreements which correctly identify <br />the appropriate operation by name and permit number, or address these man -made <br />structures through one of the other options specified in Rule 6.4.20. <br />Response to Adequacy Issue No. 14. <br />Wildcat either owns or leases the land upon which the La Plata Bridge and all pre- <br />existing access roads are located. As a result, Wildcat is the only party with an interest in <br />these structures, and no damage compensation agreement or engineering evaluation is <br />required. <br />Wildcat is submitting fully executed damage compensation agreements with the <br />following entities or individuals: <br />• Qwest Communications (underground telephone line); <br />• Fairview Land Corporation (driveway, Little Deadwood Jeep Trail, and the <br />La Plata Bridge); <br />• La Plata County Electric (electric utilities); and, <br />DEN 97,629,117x1 10 -11 -11 <br />• Ms. Vaught (fence). <br />See Ex. 8. <br />Wildcat has not been successful in obtaining damage compensation agreements for <br />the following the individuals /entities who own significant, valuable and permanent man- <br />made structures within 200 feet of the May Day Idaho Mine Complex: <br />• Citgo Properties LLC (southern parcel) (wooden fence); <br />• Aaron Taylor (steel T -post and wire fence; Mr. Taylor signed a previous <br />version of the damage compensation agreement for the Idaho Mine, but has <br />not yet signed the updated form of agreement); <br />• La Plata County (County Road 124); <br />• David and Erin Linden (well; steel T -post and wire fence); <br />• Ken and Verniece Fagerlin (well); and, <br />• O'Donnell (well). <br />GREENBERG TRAURIG, LLP m ATTORNEYS AT LAW ® WWW,GTLAW.COM <br />
