Erickson <br />Response to Sixth Adequacy <br />October 11, 2011 <br />Page 16 <br />process and to prepare any Environmental Protection Facility design required under <br />Rules 6.4.21(10), (7) and (13) for the Augmentation Pond. <br />More specifically, Wildcat will insert the following preliminary scope of work <br />prior to the "Management" section at Page 1 of Attachment D -6 ( "Augmentation Pond <br />Construction Work Plan"): <br />Water Quality Standard Investigation and Analysis: Wildcat <br />proposes to obtain water quality, flow rate data and treatment <br />alternative data, and to perform an Environmental Protection <br />Facility design and water treatment alternative analysis, as <br />needed, for the Augmentation Pond. Specifically, Wildcat <br />will perform the following: <br />o Collect additional Idaho Spring, La Plata River and <br />Deadwood Gulch water samples and obtain laboratory <br />analysis of dissolved arsenic, total arsenic, total <br />recoverable arsenic and other parameters to establish <br />statistical confidence in baseline concentrations, evaluate <br />applicable arsenic standard, and evaluate available <br />treatment options; <br />o Collect Idaho Spring and La Plata River flow data to <br />determine flow variability; <br />o Submit CDPS Permit Application and work with CDPHE <br />to determine arsenic standard applicable to discharges <br />from Idaho Spring or Augmentation Pond, and to evaluate <br />potential treatment alternatives; <br />o Review arsenic treatment technologies and treatment <br />vendors, including technologies and vendors capable of <br />treating arsenic in very low concentrations; <br />o Perform water quality, water treatment, and <br />Environmental Protection Facility design evaluations to <br />develop conclusions and recommendations regarding the <br />following: <br />• Arsenic standard applicable to discharges from <br />Idaho Spring and the Augmentation Pond; <br />• Water treatment alternatives and associated <br />treatment or reclamation costs; and, <br />DEN 97,629,117v1 10 -11 -11 <br />GREENBERG TRAURIG, LLP 0 ATTORNEYS AT LAW m WWW.GTLAW.COM <br />
