The provisions of § 37 -90- 137(2), C.R.S. prohibits the <br />issuance of a permit for a well to be located within 600 feet of any existing well, unless the <br />State Engineer finds that circumstances so warrant after a hearing held in accordance with <br />the procedural rules in 2CCR402 -5. This hearing may be waived if you are able to obtain <br />statements from the owners of all wells within 600 feet, verifying that they have no objection <br />to your use of the proposed well. Should a new well permit be denied for reasons of 600 <br />foot spacing, or any other legitimate reason, approval of this SWSP will be cancelled. <br />3. The total surface area of the groundwater exposed at the SerFer Pit must not exceed 0.50 <br />acres during the approval period of this SWSP resulting in an annual evaporative loss of <br />1.31 acre -feet, or 1.37 acre -feet during the period.of January 1, 2011 through March 31, <br />2010. <br />4. The total amount of water used for mining operations at the SerFer Pit during the period of <br />January 1, 2011 through March 31, 2010 shall not exceed 1.25 acre -feet for dust control <br />and the total product mined shall not exceed 184,803 tons of aggregate below the <br />groundwater surface resulting in 2.72 acre -feet of water lost with the product. <br />5. Total consumption at the SerFer Pit must not exceed the aforementioned amounts, as <br />shown on Table 2, unless an amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. Any future additional historical consumptive <br />use credit given (e.g., agricultural water transfer) for this site must consider all previous <br />credits given. <br />7. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. <br />8. The replacement water that is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, <br />the replacement water must be appurtenant to this site until a plan for augmentation is <br />obtained. A copy of this approval letter should be recorded with the County Clerk and <br />Recorder. All replacement water must be concurrent with depletions in quantity, timing, <br />and locations. <br />9. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. For the purposes of this SWSP, the Division <br />Engineer requires a totalizing flow meter (TFM) to be installed. The Applicant must install <br />a TFM by November 11, 2011. All diversions previous to the installation of a TFM are to <br />be approximated using the pump's hour meter and estimated flow rate of 200 qpm per <br />the SWSP renewal request. <br />10. Adequate accounting of depletions and replacements must be provided to the division <br />engineer in Greeley (Div1Accounting(state.co.us) and the water commissioner <br />(Georqe.Varrastate.co.us) on a monthly basis. All amounts shall be in acre -feet. <br />Accounting forms are subject to modification and approval by the Division Engineer. <br />11.
