Please be advised that on May 20, 2009, Mullett Excavating, LLC, whose address and telephone number are P.O. Box
322 , Westcliffe, CO 81252; (719) 783 -2056, filed an Amendment application to M- 2000 -115, Mulletts Excavting Pit # 1,
which is located at or near Section 19, Township 29S, Range 61 W, 06th Prime Meridian, in Las Animas County. The
application was originally approved by the Division on September 17, 2009. However, the Amendment 'was never
finalized because the Operator did not post the required financial warranty increase within one calendar year of the
approval of the Amendment. In accordance with Rule 4.1 (2) the approval of the Amendment must be reconsidered by
the Board and the notification procedures followed as outlined in Rule 1.6.
A copy of the application is available for review on the Division website (mining.state.co.us), at the office of the Division
of Reclamation, Mining and Safety, Room 215, 1313 Sherman Street, Denver, Colorado 80203, and at the Las Animas
County Clerk & Recorder's office.
If you desire to make comments or objections of the mine plan and /or the reclamation plan, they must be submitted
within twenty (20) days of the date of the last newspaper public notice to be considered in the application review process
by the Division. You should contact the applicant for the newspaper publication date. If we do not receive your
comments or any objection by the end of the public comment period, the Office will assume you have no objection or
comment to the proposed activity.
