• <br />S ENECA <br />Coal Company <br />Colorado Department of Public Health and Environment <br />Water Quality Control Division <br />Permits and Enforcement Section <br />4300 Cherry Creek Drive South <br />Denver, CO 80246 -1530 <br />RE: Renewal of Seneca Coal Company, CPDS Permit No. CO- 0000221 <br />Dear Sir or Madam, <br />Seneca Coal Company <br />April 22, 2011 <br />Enclosed are three sets of the above referenced permit renewal application for Seneca <br />Coal Company's (SCC or Seneca) Seneca II, Seneca IIW, and Yoast Mines (a.k.a., the <br />Seneca Mine Complex). All three mines are included in SCC's Logical Mining Unit <br />(LMU). An explanation of the LMU may be found in SCC's November 20, 1995 permit <br />amendment request sent to the CDPHE. Outfalls 002, 003 and 004 were transferred to the <br />Peabody Sage Creek Mine, CPDS Permit No. CO- 0048275, in 2010. Due to the limited <br />space on the permit renewal form, some of the information requested will be addressed <br />below. <br />Before we begin with the application, we wish to inform the Permits Units that a new <br />temporary modification for iron was recently approved by the Commission. For Yampa <br />Segment 13e, a Type iii temporary modification of the total recoverable (TR) iron <br />standard (based on `existing quality') exists on Grassy Creek. This temporary <br />modification was approved on January 10, 2011; goes into effect June 30, 2011; and <br />expires December 31, 2012. Furthermore, in an upcoming June 13, 2011 Rulemaking <br />Hearing, the Commission will propose to extend that temporary modification until <br />December 31, 2013. Outfalls 010 and 011 are in the Grassy Creek Basin. It is our <br />understanding that the temporary modification will result in a `report' only as the <br />standard until the temporary modification expires. <br />The Commission also approved (on January 10, 2011) new ambient based TR iron <br />standards for the Sage Creek portion of Yampa Segment 13e. Seneca's Outfalls 012, 013 <br />and 014 exist in the upper portion of Sage Creek; with a TR iron standard of 1250 ug /l. <br />Seneca's Outfalls 009 and 015 exist in the lower portion of Sage Creek, where the TR <br />iron standards remains 1000 ug /1. The Commission also approved new seasonal ambient <br />based TR iron standards for Yampa Segment 13d, Dry Creek. The standard for March and <br />April is 3040 ug /1. The standard for the remainder of the year is 1110 ug /l. Seneca's <br />Outfalls 005, 006, 016 and 017 exist on Dry Creek tributaries. <br />Seneca Coal Company • P.O.
