Volume 14, Rule 2.03, pg 2.03 -4 identifies surface ownership as Sage Creek Coal Company, LLC. <br />This needs to be revised to Peabody Sage Creek Mining, LLC. Please revise and update all surface <br />and mineral ownership information. <br />Response: The surface owner is actually Sage Creek Holdings, LLC. The text on page 2.03 -4 has been <br />revised. <br />4. Volume 14, Rule 2.03.5(3), pg 2.03 -6 state that Attachment 2.03 -A5 lists the Notice of Violations <br />received during a three - period prior to June 1, 2010. Please update this information to the current <br />date and, if needed, revise attachment 2.03 -A5 to reflect any changes. <br />Response: Page 2.03 -6 and Attachment 2.03 -A5 has been updated to reflect current information. <br />S. Volume 14, Rule 2.03.10, pg 2.03 -8 lists a water well permit, 22647 -F, as a Seneca II supply well. <br />Please acknowledge if this well permit remains under the Seneca II Mine permit or if the well has <br />been transferred and is in use at the Peabody Sage Creek Mine. <br />Response: Well Permit 22647 -F is still in Seneca II's name and will remain so until the well is upgraded <br />or replaced, then the well will be registered in Peabody Sage Creek's name. <br />6. The CPDS permit No. CO- 0000221 for the Pond 008 discharge currently in the Seneca II PAP expires <br />on October 31, 2011. Please provide a renewed CDPS permit or provide the Division with proof that <br />an application for renewal is currently or will be on file with CDPHE. <br />Response: The CDPHE Permit No. CO- 0000221 renewal application was submitted in April 2011. <br />Andrew Neuhart (CDHPE) indicated that the permit will most likely be put into an `administrative <br />extension' until the next Upper Colorado Basins Standards Hearing in 2014. Attached to this response <br />letter are copies of the transmittal letter and the renewal application which will serve as `proof' that the <br />renewal is currently on file with CDHPE. <br />7. Per Rule 2.04.4, please update any description of the cultural and historic resources listed or eligible <br />for listing on the National Register of Historic Places and any new significant known archaeological <br />sites existing within all areas proposed by surface activities. <br />Response: There have been no additional studies or discoveries made since the original baseline surveys <br />were conducted. <br />8. Per Rules 2.04.11(4) and 2.05.6(2), please update T &E species and discuss potential impacts to <br />current State and Federal Threatened and Endangered plant and animal species lists. The Federal <br />and State listed species of concern may have changed since the last revision.
