Design Criteria <br />Topic <br />Design Criteria for the Proposed Action <br />38. Disturbances to the prevailing hydrologic balance of the affected <br />land and of the surrounding area and to the quantity or quality of <br />water in surface and groundwater systems both during and after <br />the mining operation and during reclamation shall be minimized <br />by measures, including, but not limited to: <br />compliance with applicable Colorado water laws and regulations <br />governing injury to existing water rights; <br />compliance with applicable federal and Colorado water quality <br />laws and regulations, including statewide water quality standards <br />and site - specific classifications and standards adopted by the <br />Water Quality Control Commission; <br />compliance with applicable federal and Colorado dredge and fill <br />requirements; and <br />removing temporary or large siltation structures from drainways <br />after disturbed areas are revegetated and stabilized, if required by <br />the Reclamation Plan. <br />Stipulation <br />State Law <br />State and <br />Federal Law <br />(33 U.S.C.A <br />§§ 1251 to <br />1387) <br />State and <br />Federal Law <br />MCC Project <br />Plan, BMP <br />Drilling Water <br />39. Drilling water (< 10 acre -feet per year for shaft and MDW) will <br />be obtained from MCC's non - tributary water in the mine or <br />Minnesota Creek. This quantity of water is within the GMUG' s <br />blanket consultation with USFWS for depletion associated with <br />the Upper Colorado River System. <br />40. Within WIZ, an adequate vegetative buffer or filter strip would be <br />maintained to filter runoff from the road before it reaches the <br />creek, wherever possible. <br />42.
