In accordance with procedures outlined in 30 <br />CFR 906.30, Appendix B, the Forest Service reviewed the Revision for post- mining land use consistency <br />with land use plan (GMUG Forest Plan), and the adequacy of measures to protect non - mineral surface <br />resources, as proposed by MCC in their application. <br />According to MCC's Mine Permit, the post- mining land use is livestock and wildlife habitat. This is <br />consistent with the Forest Plan. <br />Regarding the adequacy of measures to protect Federal resources not covered by the coal lease, the <br />activities proposed by MCC are consistent with previous environmental analyzes and permitting actions. <br />We evaluated existing documentation and current conditions and have determined that if the activities <br />proposed in MR -381 are conducted consistent with the Design Criteria in the 2008 E -Seam FEIS and <br />Record of Decision, Forest Service surface resources will be adequately protected. <br />In addition, provided that the application is not further modified, and the Design Criteria of Attachment A <br />are carried forward in the DRMS' decision, this letter constitutes USFS consent /concurrence to the <br />decision. <br />Also, the FS requests that the future project related documents (e.g. decision and public notices) DRMS <br />acknowledge that protections for non - mineral resources brought forward by the GMUG as the land <br />management agency are included in the DRMS decision / documentation. <br />
