In accordance with procedures outlined in 30 CFR 906.30, Appendix B, the Forest Service reviewed the Revision for post- mining land use consistency with land use plan (GMUG Forest Plan), and the adequacy of measures to protect non - mineral surface resources, as proposed by MCC in their application. According to MCC's Mine Permit, the post- mining land use is livestock and wildlife habitat. This is consistent with the Forest Plan. Regarding the adequacy of measures to protect Federal resources not covered by the coal lease, the activities proposed by MCC are consistent with previous environmental analyzes and permitting actions. We evaluated existing documentation and current conditions and have determined that if the activities proposed in MR -381 are conducted consistent with the Design Criteria in the 2008 E -Seam FEIS and Record of Decision, Forest Service surface resources will be adequately protected. In addition, provided that the application is not further modified, and the Design Criteria of Attachment A are carried forward in the DRMS' decision, this letter constitutes USFS consent /concurrence to the decision. Also, the FS requests that the future project related documents (e.g. decision and public notices) DRMS acknowledge that protections for non - mineral resources brought forward by the GMUG as the land management agency are included in the DRMS decision / documentation.
