CERTIFIED MAIL RETURN RECEIPT NO. 7010 0780 0001 2876 1000 September 30, 2011 Mr. Jim Dupler Division of Reclamation, Mining and Safety 1313 Sherman Street, Room 215 Re: Permit No. M- 1977 -436, Brighton Mine - 112c Annual Report and Map Denver, CO 80203 Dear Jim: Enclosed is the annual report form and a drawing for the report year ended August 28, 2011 for the above - referenced permit. During the permit year ended August 28, 2011, mining continued in the central reservoir cell and mining of the entire site has now been completed. The aggregate processing plant, located in the northwestern portion of the site, remains for processing of previously excavated material. Processed material stockpiles remain within the central cell and northwest area of the project while sales and the reclamation phase of mining activity continue. Sloping of all phases of mining has been completed, and grading of the floors of the south and central reservoir cells has been completed. The north pond continued to be backfilled with overburden and wash fines during permit year ended August 28, 2011. Reclamation activity projected for the current permit year includes seeding around the reservoir cells and additional backfilling and grading in and around the north pond area. Leak tests for the slurry wall that was constructed in 2007 have been conducted by TetraTech. The south cell reservoir lining was approved by the Colorado Division of Water Resources on August 19, 2010 and the central cell reservoir lining was approved by that agency on June 9, 2011. Copies of the approval letters will be submitted with a request for bond reduction by separate letter.
