Exhibit A - Legal Description (Rule 6.3.1) <br />4. Please revise the legal description to correspond to the permitted acres (3.84) indicated on <br />the application form. The description shall be by township, range, and section, to at least the <br />nearest quarter - quarter section. A metes and bounds survey description is also acceptable. <br />Exhibit B - Site Description (Rule 6.3.2) <br />5. The Applicant states two permanent man -made structures are within 200 feet of the affected <br />boundary, however only one structure (the CDOT right of way fence) is identified. Please <br />explain this discrepancy and revise the exhibit accordingly. <br />6. The Applicant states stormwater will be contained within the pit area and drain on to the <br />adjacent Corkle Construction permitted mine site where it is dealt with under the provision of <br />its permits. Please verify the CDPHE stormwater permit for the Corkle Pit, File No. M -1995- <br />023 has been revised to incorporate the additional acreage contained in the proposed <br />reclamation only permit site. <br />Exhibit C - Mining Plan (Rule 6.3.3) <br />7. Please update the dimensions of any significant site disturbance required by Rule 6.3.3(f)) to <br />indicate the revised (3.84) permit acreage. <br />Exhibit D - Reclamation Plan (Rule 6.3.4) <br />8. The Applicant proposed a reclamation bond amount of $2,000.00 per acre. The proposed per <br />acre amount is acceptable to the Division; however the total acreage amount must be <br />updated to accommodate the revised permit acreage of 3.84 acres. The Division will set the <br />reclamation bond amount at $7,680.00. <br />Exhibit E - Reclamation Plan Map (Rule 6.3.5) <br />9. Please update the Reclamation Plan Map to indicate the revised permit boundary of 3.84 <br />acres and comply with the requirements of Rule 6.3.5 for the additional reclamation only <br />area. <br />10. Please indicate the owner(s) of record of the fences not owned by CDOT. <br />Page 2 of 3 <br />11. Please verify no above or below ground utilities or utility easements are within two hundred <br />(200) feet of the affected area. If utilities or utility easements are present, please comply with <br />the notice requirements of Rule 1.6 and revise all applicable exhibits. <br />12. Please state the average thickness of replaced topsoil in the reclamation area on the map. <br />Exhibit F - List of Other Permits and Licenses Required (Rule 6.3.6) <br />13. The Applicant indicated all other necessary permits were obtained for the entire site under <br />permit M- 1995 -023. Please confirm the existing permits include the land affected outside of <br />the approved permit boundary and encompassed in this reclamation only permit. <br />
