Director
Re: Fruita Loadout — Permit Application No. C- 2010 -088
4 Preliminary Adequacy Review — Engineering / Geotechnical
As requested in your Email dated 22- Aug -2011, I have reviewed the August adequacy response
package for the Fruita Loadout submitted by J.E. Stover & Associates on behalf of CAM -
Colorado, LLC. In addition to responding to the Division's 3' Adequacy Review, some changes
have been made to the permit application: 1) the addition of "Light Use Road #2" which
provides construction access to the permit facilities located west of Reed Wash, and 2) the
elimination of the 10 -acre "Construction Material Borrow Area" on Tavistock property.
Construction materials (embankment, pit run, etc.) will now be obtained from DRMS- permitted
gravel sources.
My earlier adequacy items have each been successfully resolved, as described below. At the end
of this letter is a new list of items I found, based on my review of the present version of the PAP.
None of the items are significant in nature, so correcting them may be possible without
presenting them to CAM in the form of a formal adequacy review letter.
2.03 Right of Entry
1 i. Item resolved with CAM's July 2011 response.
lj. Item resolved with CAM's July 2011 response.
lk. In the August response, the 10 -acre Tavistock property has been removed from the permit
area, and 5.3 acres of railroad right -of -way has been added The permit area is now given
as 215.6 acres on page 2.03 -6, a net decrease from the 222.7 acres encompassed with the
July submittal. No response required.
11. Item resolved with CAM's July 2011 response.
lm. Item resolved with CAM's July 2011 response.
1n. Is the segment of 15 Road located south of US Hwy 6 & 50 under City, or County,
jurisdiction? Will an access I driveway permit be required for 15 Road? With the July 2011
response, CAM responded that 15 Road south of US Hwy 6 & 50 is under the City's
jurisdiction, that the City will require a NOI to use its right -of -way, and that an approval
letter would be issued.
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
