Sixth Adequacy Letter, Amended CN -01 <br />May Day Idaho Mine Complex, M- 1981 -185 <br />h. Footnote number 21 on Attachment 2 is in error. As depicted on the application <br />maps, the configuration of the boundary of affected lands for the New Access Road <br />has changed since the amendment to CN -01, filed April 27, 2011. <br />Pursuant to Rule 1.4.1(3), all information submitted in an application must be accurate <br />and complete. Please submit a revised Attachment 2, which displays accurate <br />information. <br />4. If the Applicant desires to avoid a second amendment to CN -01, and return to the <br />affected land acreages declared with the first amendment, then all maps showing the <br />affected land boundary for the New Access Road must be revised to accurately portray <br />1.8 acres affected lands for the New Access Road. To date, the only map of the <br />application which approximates 1.8 acres area for the New Access Road is the survey <br />map prepared by Mountain Man Surveying, dated August 20, 2009 (1.76 acres). Copy of <br />the survey map was most recently submitted by the Applicant on August 9, 2011, as part <br />of Exhibit 0 for CN -01. <br />Therefore, if the Applicant desires to avoid a second amendment to CN -01, all maps <br />showing the boundary of affected lands for the New Access Road must reflect a <br />boundary similar to the survey map from Mountain Man Surveying, dated August 20, <br />2009. Please revise Figures C -1, C -2, C -3, C -4, C -5, C -6, C -7, D -1, D -5, G -1, I -1, 0 -1, <br />SWMP -1, U -1; and the CLC drawings C4.10, C4.11, C4.12, C4.13, C4.14, C4.20, C4.21, <br />C4.22, C4.23, C6.10, C6.11 and C7.00, to consistently reflect the same 1.8 acre boundary <br />of affected lands associated with the New Access Road. Additionally, please revise <br />Exhibit A, Legal Description, to reflect the same legal description provided by the survey <br />map from Mountain May Surveying, dated August 20, 2009. Please delete any and all <br />references from the application materials which conflict with approximately 1.8 acres <br />affected lands for the New Access Road. <br />5. Figure C -3, Existing Topography, fails to show the existing topography. At 5 -foot <br />contour interval, the existing highwalls, mine benches, and cut and fill slopes of the <br />access roads should be evident by the contour lines, but they are not. The existing <br />highwalls and mine benches are clearly evident by the 5 -foot contour lines on Figures D- <br />1, D -1 of Attachment D -2, D -1 of Attachment D -3, D -1 of Attachment D -4, D -1 of <br />Attachment D -6, D -2 of Attachment D -2, and D2 of Attachment D -6. Rather than <br />existing topography, Figure C -3 appears to show a conceptual topography and does not <br />reflect the detailed topography typically expected from a 5 -foot contour interval. Please <br />provide the basis for the topographic information displayed on Figure C -3. Since Figure <br />C -3 must be revised to address issue 4 above, please rename the revised Figure C -3 to <br />more accurately represent the conceptual nature of the displayed information. <br />6. Figure F -1, May Day 1 Reclamation Topography, indicates the near - vertical highwall will <br />be reclaimed to 2H:1V slope. Preliminary calculations indicate the quantity of backfill <br />necessary to achieve the 2H:1V slope approach 15,000 cubic yards. The Reclamation <br />Plan does not clarify the method of slope reduction. Figure F -1 does not identify any <br />5 <br />
