The Division of Reclamation, Mining and Safety (DRMS) engineering staff has reviewed the
September 9, 2011 responses ( "Response to August 22, 2011 Cazier Memorandum ") provided
by Greenberg Traurig to DRMS comments addressing selected work plans comments in Exhibit
D of the August 2011 submittal. The selected work plans in the August 2011 submittal include
the following:
a) Attachment D -2, Portal Collapse Repair Work Plan May Day No. 1,
b) Attachment D -3, Little Deadwood Gulch May Day No. 2 Drainage Control,
c) Attachment D -4, Chief Drainage and Portal Work Plan and Lamb Affected Area Little
Deadwood Gulch,
d) Attachment D -6, Augmentation Pond Work Plan.
The following comments are posed to ensure adequate engineering analyses and design practices
are implemented in accordance with Rules 6.3.3(1), 6.4.21(7) & (10), and 7.3.1(3).
For clarity, DRMS references the Greenberg Traurig "Adequacy Issue No." for each of the
following comments:
Attachment D -2, Portal Collapse Repair Work Plan May Day No. 1
Adequacy Issue No. 1: The Applicant has proposed to resolve this adequacy issue in a follow -
up Technical Revision (TR) or Amendment (AM), to be submitted subsequent to the approval
and issuance of CN -01. The three bulleted responses to this adequacy issue presented in the
subject response letter shall be included in the revised Work Plan.
Adequacy Issue No. 2: The applicant has committed to resolving this adequacy issue.
However, they have not committed to addressing this adequacy issue in a TR or AM. Please
provide a written commitment to resolve this work plan adequacy issue via the TR or AM
process. The response to this adequacy issue presented in the subject response letter shall be
included in the revised Work Plan.
