MINE ENGINEERING
MINE RECLAMATION
September 30, 2011
Daniel Hernandez
Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, CO 80203
Re: New Elk Mine Permit C -1981 -012
Technical Revision No. 59 NOV CV- 2011 -003
Dear Mr. Hernandez:
J. E. STOVER & ASSOCIATES INC.
2352 NORTH 7` STREET, UNIT B
GRAND JUNCTION, COLORADO 81501
PHONE: (970) 245 -4101, FAX 242 -7908
Qr''
pivit and Satety
CIVIL ENGINEERING
CONST. MANAGEMENT
The DRMS' e-mail dated September 28, 2011 transmitted its adequacy response for the referenced
technical revision. On behalf of New Elk Coal Company (NECC) following are its responses to the
DRMS' comments and concerns.
1. DRMS - Based on a review of the approved Map 13 in the PAP, the proposed disturbance area
runoff of the addition requested in TR59 is not delineated. Please have New Elk discuss the
manner in which the proposed disturbed area runoff will be collected and treated.
NECC - The C & W train shop, 10 stall garage and other associated structures are located on the
west side of the east mine sedimentation control system. The land slopes approximate 2% from
the C & W train shop to the east towards pond 7. Flow from this general area will be collected in
either ditch D -5 or D -6 and will be conveyed to sediment pond 7. The forth paragraph on page
2.05 -10 was inserted to explain this issue.
2. DRMS - Regarding proposed revised pages 2.05 -27, 2.05 -27a, and 2.05 -6a (Table 19), proposed
revised Map 11 -Sheet 3, and proposed revised Exhibit 28, please have New Elk revise these
materials to remove references to the 200' fixed conveyor, the 500' temporary conveyor, and
demolition and mob /demo associated with the radial stacker pads and conveyor footings. It's my
understanding that these pieces of equipment will be addressed via Minor Revision MR97, which
the Division is also currently reviewing.
NECC - Please withdraw pages 2.05 -27 and 2.05 -27a from further consideration in this technical
revision. These two pages only describe the refuse conveyors and are included in MR -97.
Enclosed are amended Table 19 and Map 11 -Sheet 3.
3. DRMS - The Division has compiled a reclamation cost estimate for the tasks associated with the
reclamation of the C &W Train Shop Facilities Area. This estimate is sufficient to reclaim all
areas associated with the proposed addition of facilities under TR59. Based on discussions with
New Elk, the proposed 200 ft fixed conveyor, 500 ft temp. conveyor and demolition work
associated with the radial stacker pads and conveyor footings will be bonded under Minor
Revision MR97. As such, those tasks have not been included in the Division's cost estimate. New
Elk submitted a reclamation cost estimate in the amount of $158, 716, which included those tasks
