Dan Hernandez - 2 Se.tember 29 2011 <br />Sincerely, <br />NECC - The permit will be updated with copies of drillers logs etc. if new information is obtained <br />from the hole. In this case only hydrology testing was performed. <br />5. DRMS - Please describe whether any part of this proposed activity will be located within a <br />"stream buffer zone" as described in Rule 4.05.18. <br />NECC - No, the hole location is further than 100 feet from the Purgatorie River and furthermore <br />no equipment or personnel will have a need to operate within the buffer zone during drilling <br />operations. <br />6. DRMS - Please describe whether any part of this proposed activity will be located within an <br />"alluvial valley floor" as described in Rules 2.06.8 and 4.24. <br />NECC - The disturbed mine site is considered an alluvial valley floor. Therefore the drilling did <br />occur within an alluvial valley floor. <br />7. DRMS - Please provide a revised map or maps showing the location of this proposed borehole. <br />Would Map 11, Sheet 3 be the appropriate to revise? Would any maps need revising as well? <br />NECC - The location of NE -16 -11 will be incorporated into Map 20, Sheet 1 with the adequacy <br />response for TR -58. <br />8. DRMS - Will this borehole be left open for a period of time for water monitoring purposes? If so, <br />please provide revised pages pertaining to the currently- approved water monitoring program. <br />Please describe the frequency of the monitoring, the constituents that will be monitored, and how <br />the results of the monitoring will be reported to the Division. <br />NECC - No, once drilled hydrological testing will occur for approximately 12 -24 hours following <br />the completion of drilling. Once complete the hole will be sealed. <br />9. DRMS - Please provide a plan for the sealing of this borehole and the reclamation of its drill pad <br />and, if constructed, its mud pit, that conforms to the requirements of Rules 2.05.4 and 4.07. <br />NECC - Borehole sealing is addressed on permit pages 2.05 -53a and 2.05 -54. A dozer will fill in <br />and level any ruts generated during the drilling process. There will be no pit to fill in and the area <br />is already a flat graveled surface, so no vegetation will be disturbed. <br />10. DRMS - Please provide revised pages pertaining to the New Elk Mine's reclamation cost estimate <br />that update the permit to include the cost of reclaiming this borehole (Rule 2.05.4(2)(b)). <br />NECC - A reclamation estimate is enclosed. <br />J. 1;: Stover, P.E. <br />Consulting Engineer <br />
