<br />NOTICE OF PROPOSED DECISION
<br />The Colorado Division of
<br />• Reclamation, Mining and Safety
<br />proposes to increase the reclama-
<br />tion liability amount for the Bear
<br />No. 3 Mine due to increases in
<br />-the costs for future reclaritation
<br />activities: The Division is propos-
<br />ing to increase. the reclamation
<br />liability amount from $130,391.00
<br />to. $146,617.66; an increase of;
<br />$16,226.66. The permittee for the
<br />Bear No. '3 Mine, permit num-
<br />ber'C- 1981 -033, is the Bear Coal
<br />Company. .
<br />The Bear No. 3 Mine is an under-
<br />ground coal operation undergo- -
<br />ing reclamation and is located in
<br />— Gunnison - .County—immediately - - -- -- —
<br />south and east of the town of
<br />Somerset,' Colorado. The North
<br />Fork of the Gunnison River and
<br />State Highway 133 are located just
<br />north of the mine. site. The per -
<br />niit'area contains 1108.4 acres of
<br />land within Sections 8, 16, 17, 18,
<br />20 and 21 of Township 13 South,
<br />Range 90 West of the 6th P.M. The
<br />permit area is contained within the •
<br />U.S. Geological Survey 7.5 minute
<br />Somerset Quadrangle map.
<br />A copy of the proposed decision
<br />and justification for the reclama-
<br />tion liability adjustment is on
<br />file for public inspection at 'the
<br />Colorado Division of Reclamation,
<br />Mining and Safety, Room 215
<br />Centennial Building, 1313 Sherman
<br />Street, Denver, Colorado 80203, at
<br />the Paonia Public Library, 2 3rd
<br />Street, Paonia, CO 81428 and
<br />at the Gunnison County Clerk
<br />and Recorder's Office, 221 N.
<br />Wisconsin, Suite C, Gunnison,
<br />Colorado 81230. .
<br />Any person with a valid legal
<br />interest which might be adversely
<br />affected by this proposed deci-
<br />sion may request a formal public
<br />hearing before the Mined Land.
<br />Reclamation Board in accordance
<br />with. Rule 3.03.2161. Requests for
<br />a'public hearing must be received
<br />by the Division within thirty days
<br />of the first publication in the Delta I
<br />County Independent. The request
<br />C be-in writing-and-must state,_
<br />with reasonable specificity, the rea-
<br />sons for requesting such a hear
<br />,ing. All requests must be submit-
<br />ted, to the Colorado Division. of;
<br />Reclamation, Mining and Safety,
<br />1313 Sherman Street,- Room 215,
<br />Denver, Colorado, 80203. If no
<br />hearing is requested within those
<br />thirty days; the Division's decision -
<br />will become final.
