Box 68 <br />Empire, CO 80438 <br />STATE OF COLORADO <br />Re: Climax Molybdenum Company, Henderson Mine, Permit No. M- 1977 -342 <br />Technical Revision No. TR -13 Approval <br />Dear Mr. Hamarat: <br />As requested by the Division of Reclamation, Mining and Safety (Division /DRMS) during the August <br />23, 2011 meeting at the Henderson Mill, Climax Molybdenum Company (CMC) provided an <br />additional copy of the following documents related to Technical Revision No. 13 (TR -13) of the <br />Henderson Reclamation Permit. <br />• Temporary Interceptor Canal Culverts and Crossings attachments <br />The Division approved TR -13 on October 2, 2002 with the following stipulation: <br />Stipulation No. 1– Technical Revision 13 <br />At the beginning of April and again at the beginning of May during each year that <br />the Interceptor Canal is impinged by the temporary culverts and crossings, the <br />snowpack will be evaluated by reference to the Jones Pass and Glen Mar Ranch <br />(Summit Ranch) Snotel sites. If the snow /water equivalent at either of these sites <br />exceeds 125 percent of average, Henderson will consult with DMG about the <br />potential need to remove the temporary culvert and crossing from the Interceptor <br />Canal prior to intensive snowmelt runoff. This consultation may include a <br />requirement to model and estimate the flows in the canal that would result from <br />snowmelt anticipated based on the Snowtel data. <br />CMC has complied with the conditions of the stipulation. However, since the inception of <br />the requirement, CMC completed construction of the "Ultimate" clean water interceptor <br />canal.
