By law, all in -situ and conventional <br />uranium mines are now classified as DMO's. Therefore, the Division is requiring the submittal of an <br />amendment to all exisiting uranium mine permits that addresses the requirements of Rule 6.4.21, <br />Exhibit U- Designated Mining Operation Environmental Protection Plans. Please be advised that the EPP <br />affects the mining and reclamation plans which will have to be addressed accordingly. All exhibits <br />should be reviewed and updated, particularly exhibits which contain maps. <br />The following steps outline and address the procedures for operators to follow in order to gain <br />compliance with the new requirements of the Act: <br />1. Operators can provide a demonstration that existing permits contain the necessary elements of <br />an EPP within 60 days of receipt of this letter (November 30, 2011). <br />2. Operators can provide written notification to the Division within 60 days of receipt of this letter <br />that final reclamation of the site will commence within one year, including any necessary <br />revisions to the reclamation plan, to ensure compliance with the new rules. Submittal for this <br />option must occur by November 30, 2011 and reclamation must commence by October 1, 2012. <br />3. Operators must submit a complete amendment application containing all necessary elements of <br />an Environmental Protection Plan to the Division by October 1, 2012. <br />4. Operators can file for an exemption from DMO designation per Rule 7.2.6. <br />The Division will continue to work with operators as they move towards compliance with the Act and <br />Rules. Operators are encouraged to schedule a meeting with Division staff to discuss the timing of <br />submission and requirements of an EPP.
