Ms. Tonya Hammond <br />Snowcap Coal Company <br />September 29, 2011 <br />Page 3 <br />reclaimed wells are still shown on this map which is fine. However, the Division <br />requests that the nomenclature in the legend be changed from "inactive" to "reclaimed" <br />for all wells that have been plugged and abandoned. <br />4. SCC is proposing with TR -62 to discontinue monitoring the flow at the outfall of Jerry <br />Creek in Main Canyon just above the confluence with the Colorado River. This is the <br />location of monitoring site SWGS -08 a concrete flume and culvert at this location. <br />Monitoring the flow of Jerry Creek at SWGS -08 was started in 1995. It has been over <br />twelve years since any mining has been conducted under Jerry Creek. All acreages and <br />disturbances associated with this monitoring site have been bond released and the <br />intermittent flow of Jerry Creek has not been adversely impacted by mining activities, the <br />Division concurs with removing SWGS -08 from the approved monitoring plan. No <br />further response is necessary. <br />Reclamation Plan <br />5. SCC is requesting approval to retain specific diversion ditches located at the North <br />Decline as permanent features. These include the West Diversion Ditch No. 1 and the <br />East Diversion Ditches No. 1 and 2. These ditches were inspected and all were found to <br />be in good condition and well vegetated. The Division concurs with leaving the West <br />and East Diversions in place as permanent features since they are stable and rarely <br />convey any significant amounts of water. Removing the ditches would create significant <br />new disturbances that are unwarranted. The landowner also agrees with retaining these <br />ditches and has requested in writing that they remain in place. No further response is <br />necessary. <br />6. The North Decline Post Mining Topography Map (Exhibit 12C) was updated with TR- <br />62. Based on our review and recent site visit we are requesting the following additional <br />change to the map and revision to permit text. The 18" V -Ditch located east of the main <br />permanent channel should be removed from the map since this is scheduled to be <br />reclaimed along with Pond 7. The two 12" V- Ditches that flow to the permanent channel <br />and the large berm at the east perimeter should remain on the map because they are <br />permanent features. The permanent feature discussion in the permit text for the North <br />Decline should be updated accordingly to reflect all permanent features to remain at the <br />North Decline. <br />Please let me know if you have any questions. <br />Sincerely, <br />Aq i dl4 F �0-111J, <br />Michael P.
