CMC is in the process of reviewing its DRMS <br />permit files to make sure that all associated commitments have been met and that the related files, <br />correspondence and authorizations are complete. As is practicable, our goal is to obtain written <br />confirmation that obligations associated with each of our technical revision and permit amendment files <br />have been satisfied. We believe this will prove useful to both CMC and DRMS, and we appreciate your <br />assistance with this effort. <br />TR -04 addresses the various environmental protection facilities and associated requirements used at <br />Henderson. One such facility is the Mine 1.2 Pond constructed in 1995. The DRMS conditionally <br />approved the construction of the proposed pond with the stipulation that CMC analyze a representative <br />sample of the pond foundation soils for shear strength in order to verify design assumptions regarding <br />stability of the pond side slopes. It was agreed that a consolidated /undrained triaxial test with pore <br />pressure measurement would be conducted on a sample of the pond foundation soils (see Attachment 1). <br />As built drawings and related project documentation, including shear strength test results, were submitted <br />to the DRMS on 12/5/1995 (see Attachment 2 — first 3 pages of 115 page submittal). A final project <br />certification was submitted on 12/18/1995 (see Attachment 3). <br />CMC believes that the information provided and /or referenced in this submittal fulfills the requirements of <br />the related 1.2 Pond stipulation. Upon review and approval, CMC requests that DRMS send written <br />acknowledgement that the above stipulation has been fulfilled. <br />
