Box 1750 <br />Canon City, CO 81215 <br />Re: Schwartzwalder Mine, File No. M- 1977 -300, Technical Revision TR -18 Extension <br />Request; Additional Requirements <br />Dear Mr. Whicker: <br />The Division of Reclamation, Mining, & Safety (Division) has reviewed the information <br />provided 16 September 2011 by Cotter Corporation (Cotter) which stated the rationale for the <br />additional extension on TR -18 and the status of completion of TR -18. Based on Cotter's <br />proposal of a phased operation for TR -18 and the Amendment that will eventually be required to <br />complete the diversion project, the Division requires the following: <br />1) TR -18 must be revised to include only the design components that Cotter proposes to be <br />• contained in Phase 1 as described on page 3 of the letter dated 16 September 2011. The <br />extension of time to complete Revision TR -18 is granted until 31 October 2011, which will give <br />the Division time to review the submittal in advance of the new decision deadline of 15 <br />November 2011. <br />2) All other necessary design components described under Phase 2 on page 3 of the letter dated <br />16 September 2011 are to be contained in an Amendment that must be submitted for the purpose <br />of expanding the affected /permit area as needed to accommodate preparation and installation of <br />the remaining components of the diversion, plus monitoring wells and any other surface or <br />underground activities that might be appropriate to include.
