Pineda, Loretta
Subject: RE: Peacock Mine
Hi Julie —
The Peacock mine site was never permitted under the permanent Coal Program (the bond that was submitted then
eventually forfeited was submitted in response to enforcement). As the Peacock mine site was never actually
permitted, a reclamation plan approved under a Coal Program permit does not exist for the site. As such, we are not
following our regulatory bond release process at Peacock like we did at previously permitted sites such as New Pryor
and Grassy Gap. Therefore, mineral owners and adjacent surface owners will not need to be identified nor contacted
prior to commencement of the activities being considered by Erica and Kirstin. I would suggest following whatever
process IMP typically follows to contact surface owners prior to initiating IMP -type reclamation activities. Let me know
if you need any additional info.
Thanks!
Dan
Daniel I. Hernandez
Daniel I. Also, do we need to notify the surrounding
landowners and mineral rights owners. We usually just notify the actual owners of the property for this stage of the
work. We just need to give the landowner notice that we will be doing some
reclamation on site with the remainder of the bond forfeiture funds.
3
