In response, Wildcat explained that it had not added any affected lands. See
Response to Fifth Adequacy, at 3 (Sept. 9, 2011). Wildcat provided as part of its
response a chart explaining that the small variations in acreage were clarifications to its
earlier submittal which resulted from the use of more accurate survey data and mapping
software to calculate acreages.
Wildcat has now re- reviewed its permit application materials, and confirmed that
the acreages stated in its April 18, 2011 Response to Preliminary and Second
Preliminary Adequacy Issues, which were incorporated by reference into its April 27,
2011 permit amendment, are accurate; except that Wildcat has removed exploration
roads and drill pads from its application. Specifically, Wildcat has included the
following affected lands in its amended permit application:
DEN 97,616,201v1 9 -27 -11
GREENBERG TRAURIG, LLP ® ATTORNEYS AT LAW ® WWW.GTLAW.COM
The Tabor Center ® 1200 17th Street ® Suite 2400 a Denver, CO 80202 ® Tel 303.572.6500 ® Fax 303.572.6540
