T h N MIN N:3 6 SAFETY <br />The Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and <br />Environment (Division) received an Application for a Certificate of Designation (Application) for the Western <br />Gravel E &P Waste Disposal Facility from Western Gravel LLC. The Application dated March 1, 2011was referred <br />to the Division by Rio Blanco County and received April 4, 2011. The Application proposes 57.4 acres for a <br />Certificate of Designation located in Section 6 of Township 1 North and Range 96 West with an approximate <br />physical address of 41138 County Road 5 in Rio Blanco County (County). The facility proposes to operate a solids <br />treatment operation which would accept only waste (solids) from exploration and production activities that are <br />exempt from the Resource Conservation and Recovery Act (RCRA) regulation as a hazardous waste. Western <br />Gravel currently operates a sand and gravel mine on the property. The pits resulting from the mining would be <br />recontoured and lined with a double synthetic liner, leak detection system and leachate collection system prior to <br />acceptance of waste. In accordance with the solid waste statute C.R.S., 30 -20 -103 (2) a "completeness review" of <br />the Application was conducted and in correspondence dated May 2, 2011 the Division determined the Application <br />to be complete. <br />The Application was reviewed to determine its compliance with the requirements set forth in the Solid Waste <br />Disposal Sites and Facilities Act, Title 30, Article 20, Parts 1 and10 of the Colorado Revised Statutes, as amended, <br />and with the regulations promulgated there under 6 CCR 1007 -2 (Regulations). In accordance with the solid waste <br />statute C.R.S., 30 -20 - (2) a "technical evaluation" of the Application has been completed to determine <br />compliance with the requirements set forth in the Regulations. The purpose of this correspondence is to provide <br />written technical review comments, which are listed below. <br />D &O Sections 1 -7 <br />1. 2.3.2.5- 2.3.2.6 - Additional information is requested to identify geomorphic features or other surface <br />indications of historically unstable areas particularly along the steep slope to the north (southern bank of the <br />White River) as well as the hills elevated above the site to the south. Please research published technical <br />documents or conduct field mapping for the site and the nearby lands with a similar site condition. <br />
