Sincer
conceptual in nature and fail to provide the information required by the Act and
Rules. However, given the Cease and Desist Orders associated with the unresolved
violations, the Applicant is somewhat limited to conceptual plans where additional
geotechnical and /or geochemical information are required. Therefore, the Division
could accept conceptual work plans if the plans include a thorough description of
the process for information collection, analysis, submittal for Division approval and,
implementation upon receiving Division approval, and a commitment to submit the
newly collected information, updated analysis and resulting finalized designs to the
Division through either the Technical Revision or Amendment process. The
conceptual work plans provided in the application did not commit to follow -up
Technical Revisions or Amendments. The absence of such commitment, specifically
stated within each of the individual work plans, is grounds for denial of the
conceptual work plan.
Pursuant to paragraph (3)(f) of the Joint Stipulation, the Applicant has agreed to address the
Division's adequacy issues at least two weeks prior to the decision date. Therefore, please
respond to the adequacy issues identified in this letter and in the four attached technical
review memorandums from staff members David Bird, Peter Hays and Tim Cazier, no later than
September 12, 2011. If additional time is required to respond to these adequacy issues, please
submit a written request for extension of the review period.
The Division reserves the right to further supplement this document with additional adequacy
issues and details as necessary.
Please contact me at the Division's office in Durango at 691 County Road 233, Suite A -2,
Durango, CO 81301, phone (970) 247 -5469, if you have any questions.
Wallace H.
