Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />RE: Wildcat Mining Corporation, May Day Idaho Mine Complex, File No. M- 1981 -185, <br />Review of the New Access Road submittal dated August 9, 2011, for CN -01. <br />The Division has reviewed the geotechnical and stability analysis and other related information, <br />included with the May Day Idaho Mine Complex, File No. M- 1981 -185, permit conversion (CN -01) <br />application package submitted on August 9, 2011. <br />The following adequacy issues must be addressed to the satisfaction of the Division prior to the <br />Division recommending approval of CN -01. Furthermore, after CN -01 is issued, the Division must <br />receive, review and accept the revised geotechnical report and the as -built drawings (if required) for <br />the reconstructed access road prior to the road being fully approved <br />The review specifically addresses the following sections: 6.4.4 Exhibit D — Mining Plan, 6.4.4 Exhibit D <br />— Mining Plan Attachment 1— New Access Road Construction Work Plan, 6.4.5 Exhibit E — <br />Reclamation Plan and Exhibit 6.5 — Geotechnical Stability Exhibit Attachment 6.5.3 — Geotechnical <br />Reconnaissance — Mine Access Road <br />6.4.4 Exhibit D — Mining Plan Attachment 1— New Access Road Construction Work Plan <br />1. In the Background section of the Work Plan the Applicant lists and summarized the letters and <br />memos from the Division outlining design and construction deficiencies. The list contained <br />several omitted Division memos and errors. The Applicant did not include the memo dated May 17, 2010 from Mr. Allen Sorenson <br />to Wally Erickson — Idaho Mine Access Road <br />b. The Applicant referred to the March 11, 2011 Memorandum from Mr. Cazier which <br />addressed the portal geotechnical stability, not the access road stability. <br />c. The Applicant appears to have mislabeled the March 7, 2011 Memo from Mr. Hays and <br />Mr. Cazier as May 7, 2011. <br />d.
