First Street <br />Trinidad, CO 81082 <br />Re: Final Approval, Permit Revision PR -02 <br />New EIk Coal Company, The New EIk Mine, DRMS Permit No. C- 1981 -012 <br />Dear Mr. Thompson: <br />The Division issued its Proposed Decision to Approve Permit Revision PR -02 for the New EIk Mine on <br />August 19, 2011. The Division ran its Notice of Proposed Decision in Trinidad's Chronicle -News <br />newspaper once a week for two consecutive weeks, beginning on August 25, 2011. The 30 -day public <br />comment following our Notice of Proposed Decision ended at 5:00 pm yesterday, with the Division <br />receiving no requests for a Formal Public Hearing. Our Proposed Decision is therefore Final. <br />An increase in reclamation liability associated with the monitoring wells that were transferred from <br />the Golden Eagle Mine to the New EIk has raised the reclamation liability for the New EIk Mine from <br />$3,778,562.00 to $3,801,833.00. The Division presently holds reclamation bonds totaling <br />$3,824,698.00; therefore, no additional reclamation bond needs to be submitted at this time. <br />Please contact me if you have any questions. <br />Sincerely, <br />Daniel I.
