Binns, Janet
From: W D Corley, Jr. [ajjc @att.net]
Sent: Tuesday, September 20, 2011 9:30 AM
To: Binns, Janet
Subject: Energy Fuels pond EC
Ms. Binns,
George Patterson said yesterday that he had talked with you about partially leaving their pond no. 5 in place to
catch storm water runoff and slowly release that water into the drainage. He said that you indicated that the
Division had allowed such a practice in the past and that it was entirely possible.
You also outlined at the recent inspection and in your report the conditions which would govern the retention of
the pond regarding The Corley Co. obligations, i.e. agreement with Energy, our assumption of maintenance
requirements, and State Health Dept. water quality regs. In the event that the Division and Energy agree to the
partial retention of the pond along the lines that George talked about with you, what would then be The Corley
Company obligations? Would we still have to comply with the conditions you outlined?
W.D. Corley, Jr.
1
La r
PSIS
