AUGUST 8, 2011 <br />MAY DAY MINE CLASS II - SUBMITTAL 2 REVIEW <br />PAGE 9 OF 15 <br />8. The "Geotechnical Reconnaissance" report dated May 29, 2010 and revised January 5, 2011 by <br />R- Squared states a,Work Plan shall be prepared and implemented by an "experienced <br />geotechnical engineer ". <br />a. The Work Plan shall be bound and sealed by the experienced geotechnical engineer <br />preparing the report, who shall be a Professional Engineer registered in the State of <br />Colorado. <br />C. Construction Plan Set Dated 4.12.2011 with Sheet C 3.10 subsequently added <br />1. A full list of comments on the Construction Plan Set were provided in the May 20, 2011 <br />Planning Engineering letter and are reiterated in Subsection IV below. <br />2. Sheet C3.10 and the Mining Plan (addressed in "A" of this section) introduce three proposed <br />staging areas. <br />a. The new Sheet C 3.10 shows the staging area near CR 124. Please revise to show adequate <br />parking (1 space per employee) and to show fencing or berming that will provide intended <br />visual and noise buffering as indicated on the "Mining Plan" (discussed under "A" of this <br />section). Also include a grading plan for the staging area. <br />b. The Mining Plan indicates there are two additional staging areas planned — at the low point <br />of the access road near the La Plata River and at May Day Level 2. Detailed site and <br />grading plans are needed. <br />D. Project Narrative dated 5.20.2011 <br />1. Page 2 states that all road structures have been design by a Colorado registered civil, <br />geotechnical engineer and hydrogeologist. <br />a. Note that while hydrogeology input and evaluation is understood key to the project, all <br />road design elements — Construction Plans, Geotechnical Work Plan and Specifications, <br />and Drainage Plan may be prepared and sealed only by a Professional Engineer registered <br />in the State of Colorado. Note that each respective document must be bound so that it is <br />clear the PE is certifying all information presented in that document <br />2. Page 6 states that a Fire, Rescue, and Emergency Plan is under review by the County Office of <br />Emergency Management and the Fort Lewis Mesa Fire District. <br />a. Please note that at this point the Fire, Rescue, and Emergency Plan (aka "Emergency <br />Management and Response Plan") has not been received by County OEM, County <br />Planning, or FLMD. All three entities must receive for review and ultimately accept the <br />Emergency Management and Response Plan for the road variance and Class II permit to be <br />supported. <br />E. Letter to Victoria Schmitt dated May 12, 2011 <br />1. This letter contains several items that remain open issues already addressed in the document <br />reviews above. These include: <br />a. Pages 2 and 3 suggest Emergency Management and Response Plan and corresponding road <br />plans are resolved.
