Jerry, <br />Attached is the preliminary adequacy review for the proposed plan to address the issues associated with CV- <br />2011 -005. Comment No. 2 is based on information received by the Minerals Program. Any activities <br />conducted on the Deakins Pit or Ross Pit sites fall under the Minerals Program regulatory jurisdiction, including <br />the activities proposed by Twentymile Coal to address the abatement of the above mentioned NOV. <br />With regard to the 15 -day period to provide information, it was mentioned in our phone conversation this <br />morning that TC would submit information via email today.
