2. Attached is the reclamation cost estimate for the 2012 Seneca II Mine Permit Renewal, RN -6.
The Division updated the reclamation cost estimate with 2011 costs. This updated estimate
total is $665,763.78. This estimate includes reclamation tasks identified in the permit that were
updated with Permit Revision No. 2 (PR -2). PR -2 updated the entire mine site based on a
revised permit boundary due to the approval of the Peabody Sage Creek Mine (C- 2009 -087).
This RN -6 revised cost estimate is $13,894.78 more than the current liability of $651,869.00.
The revised liability in the RN -6 estimate is $13,894.78 more than the current bond held of
$651,869.00.
There was one change in the equipment and volume numbers for the Pond 008 one -time clean
out during the liability to reflect the approved Exhibit 7 -17C of the Pap since the 2010 PR -2
estimate. The one -time Pond 008 clean-out also included a Pumping task (022) that was not
included in the PR -02 estimate. Cost increases are from increased equipment and materials
costs. Based on the RN -06 estimate, the liability of the Seneca II Mine has increased
approximately 2 %.
Please provide an update to Tab 13, Attachment 13 -1 to reflect the new proposed permit term
and the new bond calculation.
3. Volume 14, Rule 2.03, pg 2.03 -4 identifies surface ownership as Sage Creek Coal Company,
LLC. This needs to be revised to Peabody Sage Creek Mining, LLC. Please revise and update
all surface and mineral ownership information.
4. Volume 14, Rule 2.03.5(3), pg 2.03 -6 states that Attachment 2.03 -A5 lists the Notice of
Violations received during a three -year period prior to June 1, 2010. Please update this
information to the current date and, if needed, revise attachment 2.03 -A5 to reflect any
changes.
5. Volume 14, Rule 2.03.10, pg 2.03 -8 lists a water well permit, 22647 -F, as a Seneca II supply.

6. The CDPS permit No. CO- 0000221 for the Pond 008 discharge currently in the Seneca II PAP

with proof that an application for renewal is currently or will be on file with CDPHE.
