Pitieda <br />Director <br />The Division received Hayden Gulch Terminal, LLC.'s (HGT) application for a Permit Revision (PR- <br />1) on July 18, 2011. The application was determined to be complete on August 4, 2011. No concerns <br />have been received from other agencies regarding this proposed permit revision as of the date of this <br />letter. The Colorado Division of Reclamation, Mining and Safety has completed its adequacy review <br />of the proposed technical revision. Please respond to the following comments or concerns as <br />necessary: <br />1. In Volume I, Tab 1 on page 3 in the first paragraph it is stated that "the permitted area is 176.3 <br />acres, of which 105.5 is identified as being disturbed." With the addition of the Tie Across <br />Haul Road (TAHR) proposed these acreage numbers will need to be adjusted. Please provide <br />a proposed revised page that reflects the total proposed permitted acreage and the total <br />proposed disturbed acreage. <br />COLORADO <br />D I V I S I O N O F <br />RECLAMATION <br />MINING <br />— &— <br />SAFETY <br />2. Pages 4, 5, and 6 in Tab 3 of Volume I lists; the holders of record of any leasehold interest <br />within the permit boundary; Holders of record of any easements on the property; and owners of <br />surface, coal, oil, and gas rights contiguous to the permit boundary. Due to the proposed <br />change in the permit boundary these names may or may not have changed or names may or <br />may not need to be included. The PR1 application included revised Appendix 3 -2, 3 -3, and 3- <br />4. However, pages 4, 5, and 6 also list the names for each respective holder of record and <br />owner. Please provide revised versions of the above mentioned pages to reflect the <br />proposed addition of the TAHR to the HGT permit. <br />3. Approved Exhibit 3 -1 Surface Ownership, Exhibit 3 -1A Easements, and Exhibit 3 -2 Mineral <br />Ownership & Control do not reflect the surface ownership, easements, and mineral ownership <br />associated with the area of the proposed TAHR.
