Pete Conovitz <br />August 10, 2011 <br />Page 3 of 5 <br />depletions from the 8.5 -acre pond was calculated using the Integrated Decision Support Alluvial Water <br />Accounting System ( "IDSAWAS ") model with the 7 -day SDF option starting in water year 1997 and <br />going through the end of October 2011. <br />Replacement Sources <br />CDOW owns one share of the Jackson Lake Reservoir and Irrigation Company Stock which will <br />be used to replace irrigation season depletions. This share was one of the two shares changed to <br />augmentation in case no. W- 8561 -77. This share has not been used at the location described in case <br />no. W- 8561 -77 since CDOW acquired the property and share in 1983. The decree in case no. W -8561- <br />77 states that the "Jackson Lake Private Right yields an average of 16 acre -feet of water per year per <br />right and the historical consumptive use of this water for irrigation purposes has been 50% of the <br />delivered amount, so that the Applicant is entitled to the amount of consumptive use or 16 acre -feet for <br />the two rights combined ". Thus the consumptive use amount for CDOW ownership of one share is 8 <br />acre -feet. Jackson Lake Reservoir is located 30 miles upstream of Chartier Pit; therefore transit losses <br />of 0.5% per mile were included in the depletion calculation. CDOW is proposing an aggregate release <br />of the Jackson Lake Reservoir water during the irrigation season to replace irrigation season <br />depletions. The release of replacement water from Jackson Lake Reservoir may be aggregated to <br />maximize beneficial use; however, the rate and timing of an aggregated release shall be determined by <br />the water commissioner and/or division engineer. <br />According to paragraph 5(c)I of the water court application in case no. 2006CW229, CDOW <br />may utilize augmentation credits from the Riverside Irrigation District or water available from another <br />plan for augmentation. You indicated that in 2009 CDOW acquired a 20% interest in the Goodrich <br />Farms recharge and augmentation plan decreed in case no. 90CW10 (W- 2919). Therefore for the <br />purpose of, this SWSP, CDOW intends to utilize augmentation credits from Goodrich Farms recharge <br />and augmentation plan to replace the winter months depletions. These credits accrue to the South <br />Platte River in approximately the same location as the Jackson Lake Inlet Canal water. The attached <br />Table 4 shows the proposed accounting of the Goodrich Farms augmentation credits which will be used <br />to replace the Chartier Pit winter month depletions. <br />Conditions of Approval <br />This SWSP is hereby approved pursuant to C.R.S. § 37- 92- 308(4), subject to the conditions stated <br />below: <br />1. This SWSP shall be valid for the period of July 1, 2011 through June 30, 2012, unless otherwise <br />revoked, modified, or superseded by decree. The initial date of approval for this SWSP was <br />November 28, 2007 for operation beginning July 1, 2007. Pursuant to § 37- 92- 308(4)(b), C.R.S., <br />"If an applicant requests renewal of a plan that would extend the plan past five years from the <br />initial date of approval, the applicant shall demonstrate to the water judge in the applicable <br />water division that the delay in obtaining a decree has been justifiable and that not being able to <br />continue operating under a substitute water supply plan until a decree is entered will cause <br />undue hardship to the applicant." This SWSP will not be approved for the 2012 — 2013 <br />period unless we receive evidence from the court that the applicant has met this <br />requirement. Additional SWSPs are required until a court decreed plan for augmentation is <br />obtained for the proposed uses. Should an additional SWSP be requested, the provisions of § <br />37 -92- 308(4), C.R.S., shall apply. The statutory fee of $300 will be required pursuant to § 37- <br />92- 308(8), C.R.S. Any request for an additional SWSP must be submitted to this office no later <br />than March 31, 2012. <br />
