DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
September 16, 2011
Mr. Chip Brown
Colowyo Coal Company
5731 State Highway 13
Meeker, CO 81641
RE: Colowyo Mine, Permit C- 1981 -019
Review of First Quarter 2011 Discharge Monitoring Reports
for CDPHE Permit No. CO- 0045161
Dear Mr. Brown:
The Colorado Division of Reclamation, Mining and Safety (the Division) has reviewed and found the above
referenced report to be in compliance with Rule 4.05.13(2). The Discharge Monitoring Reports were received
by the Division on April 7, 2011. The reports cover the time period from January 1, 2011 through March 31,
2011.
Five CDPS outfalls discharged during the first quarter of 2011: Outfalls 001, 002, 003, 005, and 007.
Colowyo's surface water monitoring activity revealed one exceedance of a primary effluent limitation during the
quarter. At Outfall 007A (Prospect Pond), Total Recoverable Iron was found to exceed the 30 -day average
concentration of 1.0 mg/L on March 1, 2011. The measured value was 2.83 mg/L. However, evidence provided
by Colowyo to the Division (photographs and temperature data) suggests that the runoff during this exceedance
was due to snowmelt. Furthermore, the alternate limitation for settleable solids was met. The Colorado
Department of Public Health and Environment was informed of the exceedance. The Division requests no
further action on this matter.
If you have any questions feel free to contact me at 303 - 866 -3567 (ext. 8113).
Sincerely,
Robert D.
