An application for a change of water right (to allow the applicant's Rural Ditch <br />shares to be used in addition to irrigation for augmentation, replacement, exchange, commercial, <br />industrial, recreational, piscatorial, wildlife propagation and storage) and approval of a plan for <br />augmentation was filed with the Water Court in Case No. 2003CW306. The historical consumptive <br />use of the four shares of the Rural Ditch water averages 265.50 acre -feet per year with an historical <br />return flow obligation of the four Rural Ditch shares of 101.5 acre -feet. Excess consumptive use <br />credits from the four shares of Rural Ditch stored in the 112 Reservoir will also be released to replace <br />non - irrigation season depletions for the Durham Pit and,Everist's Lohmann Pit, Rinn Valley Pit, <br />Firestone Pit, Fort Lupton Pit and Lupton Meadows Pit. <br />To the extent possible, the return flow obligations will be supplied using VCI's consumptive <br />• use credits from Hayseed Ditch. The change of use from the Hayseed Ditch water owned by VCI was <br />decreed in case no. 1990CW174: If Hayseed Ditch credits are not sufficient to replace the actual <br />obligation, releases from the lined pits or replacement using direct flow will be made. <br />The water rights decreed in case no. 2001 CW274 can be used directly at the points of <br />diversion or retained in reservoirs for storage when the water rights are in priority or used by <br />exchange for releases from any or all of the reservoirs or any or all of the direct flow sources. The <br />decreed information for these junior water rights is shown in the following table: <br />cfs. Storage rates are 90 cfs for Rural Ditch and Godding Ditch, 10 cfs for Godding Hollow and 100 cfs for Last <br />Chance Ditch. <br />Note: <br />Total <br />direc <br />t <br />diver <br />sion <br />from <br />all <br />sour <br />ces <br />not <br />to <br />exce <br />ed <br />11 <br />Four of these facilities identified as: the 112 Reservoir, Dakolios (East and West) Reservoirs <br />and Von Ohlen Reservoir will be used in this SWSP to store water available from Last Chance Ditch, <br />Rural Ditch and Hayseed Ditch. According to the decree in case no. 2001 CW274, water stored in the <br />reservoirs may be used for replacement of depletions at the mining sites owned or leased by VCI. <br />The Western Sugar Pit site has been identified as one of the mining sites where the junior water <br />rights decreed in case no. 2001 CW274 may be used as a source of replacement water. You have <br />provided reservoir operations study using the storage facilities as a whole. The beginning storage <br />contents were a combination of diversions from the Rural Ditch water and junior water diverted in <br />priority in accordance with the decree in case no. 2001 CW274. The attached Tables 2A and 2B <br />(Reservoir Operations Study) show the reservoir operations from May 2011 through April 2013.
