acres, backfilled to two feet above the average ground water elevation came to over
$3,000,000.00. The letter sent in 2005 explaining the cost is included in this adequacy
letter.
2) The operator is correct, once the Division receives the approved QA /QC report from the
State Engineer, the required warranty for the slurry wall will be 20% of the cost of
construction. Since the operation is going to be in Temporary Cessation and the Division
is required to hold a financial warranty for the site that is adequate to cover the cost of
current affected area and area expected to be affected the next year, at this time no
additional warranty will be needed. Prior to commencement of the operation, Pete Lien
& Son will submit a Technical Revision addressing the slurry wall. This amendment will
be approved with conditions requiring Pete Lien and Son to submit a revision prior to
commencement of operation.
If you have questions, please contact me at 303 866 3567 ext 8129.
Sincerely
erhan Keffelew
Environmental Protection Specialist
CC: Tony Waldron
1
