OBSERVATIONS <br />PERMIT #: M -1981 -158 <br />. INSPECTOR'S INITIALS: KAP <br />INSPECTION DATE: August 18, 2011 <br />This inspection was conducted as part of the Division of Reclamation Mining and Safety monitoring program. <br />Present at the inspection were Dale Kortz and Ricky Ludwig, Forest Lakes Metropolitan District, and Kate <br />Pickford, DRMS. <br />The site consists of ponds related to the water treatment plant for the Forest Lakes subdivision, plus one pond <br />that has been excavated due to material being removed for road maintenance within the subdivision. Some of <br />the slopes along the excavated pond are sloped at approximately 3:1, but grading is needed along much of the <br />pond edge. Mr. Kortz indicated that Forest Lakes Metro District is working on a temporary substitute supply <br />plan for the exposed water in the pit. However, he is also considering filling the pit, so that no water is <br />exposed. The current water exposure is seasonal, according to Mr. Kortz, and the pond dries up during drier <br />seasons when no irrigation is occurring. <br />Mr. Kortz indicated that material from the landslide near Helen's Store is being brought in to the site to <br />backfill the pit, and that materials from other sources may be brought in to complete the filling of the pit. <br />The Division believes that the Forest Lakes Metro District should submit an amendment to this permit to <br />address the following issues: <br />1.) The current post- mining land use is recreation. Whereas much of the permitted area composes the water <br />treatment facility for the Forest Lakes subdivision, the post mining land use would more accurately be defined <br />as industrial. <br />2.) The Metro District should request, in the amendment, a reduction of the acreage contained in the permit, <br />to eliminate all of the areas devoted to the water treatment facility, so that the Metro district is able to <br />manage this facility without regulation under the mining permit <br />3.) The Metro district MUST submit materials as defined in Rule 3.1.5(9) regarding the materials being brought <br />to the site for backfilling, prior to the commencement of any backfilling incorporating these materials. <br />4.) If the remaining pond is ultimately to be backfilled, resulting in no exposed groundwater within that pit, <br />this should be included in the amendment application. <br />As part of this inspection, the bond amount for reclamation of the site was reviewed. It was determined that <br />the current amount of $11,688.00 is adequate for reclamation of the site. <br />Page 2 of 4 <br />
