END
SEP 0 9 2011
GRAND ,IUidt;r:UN _ :; OFFICE
DIVISION OF
RECLAMATION MINING & SAFETY
The Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and
Environment (Department) received an Application for a Certificate of Designation (Application) for the Western
Gravel E&P Waste Disposal Facility from Western Gravel LLC. The Application dated March 1, 2011was referred
to the Department by Rio Blanco County and received April 4, 2011. The Application proposes 57.4 acres for a
Certificate of Designation located in Section 6 of Township 1 North and Range 96 West with an approximate
physical address of 41138 County Road 5 in Rio Blanco County (County). The facility proposes to operate a solids
treatment operation which would accept only waste (solids) from exploration and production activities that are
exempt from the Resource Conservation and Recovery Act (RCRA) regulation as a hazardous waste. Western
Gravel currently operates a sand and gravel mine on the property. If the current proposal is approved the pits
resulting from the mining would be recontoured and lined with a double synthetic liner, leak detection system and
ieachate collection systeni prior to acceptance of waste. The facility will be developed in phases. In accordance
with the solid waste statute C.R.S., 30 -20 -103 (2) a "completeness review" of the Application was conducted and in
correspondence dated May 2, 2011 the Department determined the Application to be complete.
The Application was reviewed to determine its compliance with the requirements set forth in the Solid Waste
Disposal Sites and Facilities Act, Title 30, Article 20, Parts 1 and10 of the Colorado Revised Statutes, as amended,
and with the regulations promulgated there under 6 CCR 1007 -2 (Regulations). In accordance with the solid waste
statute C.R.S., 30 -20 -103 (2) a "technical evaluation" of the Application is required. This effort is nearing
completion and we hope to provide technical comments to the Applicant in the next week. In the County's referral
letter and our meeting August 31, 2011 . you requested that the Department provide a letter (for County
Planning purposes) describing the results of the technical review with regards to the geology, hydrogeology and
other site conditions (bedrock, groundwater, etc.) and the testing and other technical information submitted by the
applicant. You have stated that the County is relying on the Department's technical expertise in lieu of hiring a
third party. The purpose of this correspondence is to respond to the County's request so that the county planning
process may continue.
