Townsend Ave. <br />Montrose, CO 81401 <br />RE: Withdrawal of Enforcement Action, Reason to Believe a Violation Exists, Failure to Maintain <br />Financial Warranty, Bellgardt Pit, Montrose County, Permit No. M- 2006 -032. <br />Dear Ms. Hale and DeVincentis: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) received Margaret Hale's replacement <br />financial warranty documents on September 1, 2011. Staff has reviewed and accepted the bonding <br />documentation. This replaces Washington International bond # S9039346 in the amount of $50,213.00 <br />which is now released. Therefore the Division is withdrawing the enforcement action before the Mined <br />Land Reclamation Board scheduled for September 14, 2011. <br />Currently the Division has an outstanding incomplete application for an amendment to change the post <br />mine land use and revise the reclamation plan received on June 13, 2011. Usually if the issues are not <br />addressed within 60 days the amendment is denied. However, since the amendment was delayed due <br />to the above mentioned warranty issue staff is giving you an additional 30 days to submit the <br />information and fee as outlined in a letter dated June 25, 2011.
