Notice of Continuance of Formal Board Hearing for Forfeiture of Financial Warranty.
In summary, the original hearing has been continued, it will now occur during the October 12 and 13, 2011 Board
meeting. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m.
on October 12 or as soon thereafter as the matter can be considered. Please contact Sitira Pope of the Division at

The Colorado Division of Reclamation, Mining and Safety (Division) sent you a letter dated August 10, 2011. This
letter was to notify your bank in regards to a hearing to be held during the September 14 and 15, 2011 meeting of the
Mined Land Reclamation Board (Board). The hearing was for the possible forfeiture of the Letter of Credit ( #
your bank holds as a Financial Warranty for M S Forest, LLC. On September 7, 2011, M S Forest, LLC
submitted a petition to our Office for a reconsideration of the Board's decision that the Financial Warranty is subject
for forfeiture. Given this, the hearing scheduled to occur during the September 14 and 15, 2011 Board meeting has
been continued until the October 12 and 13, 2011 Board Meeting. At the meeting, the Board may reconsider its
decision that the Financial Warranty is subject to forfeiture. If not, a hearing will be held to fmalize the matter and
forfeit the Financial Warranty.
